If you reside in the United States and received Continental Cafe Holdings, LLC’s November 12, 2024, notice of the Data Incident and you are not party to any arbitration agreement with Continental implemented on March 14, 2019, and/or July 18, 2023, then you may be a Settlement Class Member and eligible for benefits. Excluded from the Settlement Class are: (i) all Persons who timely and validly request exclusion from the Class; (ii) the judge assigned to evaluate the fairness of this settlement (including any members of the Court’s staff assigned to this case); (iii) Defendant’s officers and directors, and (iv) any other Person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Data Incident or who pleads nolo contendere to any such charge.
If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by July 28, 2026.
All Settlement Class Members may claim Credit Monitoring and one of two Cash Payment options. The benefits are explained in more detail below.
Credit Monitoring and Identity Theft Protection Services. All Settlement Class Members are eligible to enroll in three (3) years of one-bureau credit monitoring and identity theft protection services.
Payment for Unreimbursed Out-of-Pocket Losses. If you incurred actual, documented out-of-pocket losses due to the Data Incident, you can get back up to $700.00. The losses must have occurred between October 18, 2024, and July 28, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:
costs and expenses spent addressing identity theft or fraud
preventative costs including purchasing credit reports, placing security freezes on credit reports, or requesting copies of credit reports for review
other documented losses that were not reimbursed
To claim reimbursement for out-of-pocket losses, you must submit documentation supporting this claim, including, but not limited to credit card statements, bank statements, invoices, telephone records, and receipts You can also send notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim.
Alternative Cash Payment. In lieu of submitting a claim for documented out-of-pocket losses, you may submit a claim for an alternative cash payment of up to $50.00. The election to receive an alternative cash payment does not preclude Settlement Class Members from enrolling in credit monitoring and identity theft protection services offered under the Settlement.

The deadline to submit a Claim Form online is July 28, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than July 28, 2026.
